1. Introduction & Acceptance

Welcome to BookMyDentist ("Platform," "we," "us," or "our"). BookMyDentist is operated by VCPility and provides a comprehensive dentist empowerment system that connects dental professionals with patients worldwide while offering business growth tools, resources, and support services.

By accessing or using BookMyDentist, whether as a dental professional ("Dentist") or as a patient seeking dental services ("Patient" or "User"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use our Platform.

These Terms constitute a legally binding agreement between you and BookMyDentist. We reserve the right to modify these Terms at any time, and continued use of the Platform after changes constitutes acceptance of the modified Terms.

2. Platform Services

2.1 For Dentists

BookMyDentist provides dentists with a comprehensive empowerment system including:

  • Enhanced practice visibility and professional profile management
  • Automated patient booking and appointment management tools
  • AI-powered communication and patient engagement systems
  • Business growth resources, analytics, and insights
  • Professional development opportunities and coaching
  • Dedicated support and platform guidance
  • Access to dental tourism and NRI patient networks

Dentists pay subscription fees to access these services. Subscription terms are detailed in our Refund & Cancellation Policy.

2.2 For Patients

BookMyDentist provides patients with:

  • Free access to verified dentist profiles and clinic information
  • Online appointment booking system (no booking fees)
  • Dentist search and comparison tools
  • Access to dental tourism opportunities worldwide

BookMyDentist does not charge patients for using the Platform or booking appointments. All treatment fees and consultation charges are paid directly to the dental clinic.

2.3 Platform Role

BookMyDentist acts as a facilitator connecting dentists and patients. We do not provide dental services, medical advice, or treatment. We are not responsible for the quality, safety, or outcomes of dental services provided by dentists listed on our Platform. All dental services are provided independently by licensed dental professionals.

3. User Eligibility & Account Registration

3.1 Dentist Eligibility

  • Must hold a valid dental license in the jurisdiction where you practice
  • Must provide accurate credentials, qualifications, and clinic information
  • Must comply with all applicable dental regulations and professional standards
  • Must be at least 18 years of age
  • Applications are subject to verification and approval by BookMyDentist

3.2 Patient Eligibility

  • Must be at least 18 years of age or have parental/guardian consent
  • Must provide accurate personal and contact information
  • Must use the Platform in accordance with these Terms

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. BookMyDentist is not liable for any loss or damage arising from your failure to protect your account information.

4. Dentist Obligations & Responsibilities

  • Professional Standards: You must maintain all required licenses, certifications, and professional standards in your jurisdiction.
  • Accurate Information: You must provide and maintain accurate, current information about your qualifications, services, and clinic details.
  • Appointment Management: You must honor confirmed appointments or provide reasonable notice of cancellation as per our cancellation policies.
  • Patient Communication: You must respond to patient inquiries and booking requests in a timely and professional manner.
  • Compliance: You must comply with all applicable healthcare regulations, data protection laws, and professional codes of conduct.
  • Subscription Payments: You must maintain current subscription payments to continue accessing Platform services.
  • Prohibited Activities: You must not engage in fraudulent activity, misrepresentation, false advertising, or any activity that violates professional ethics.

5. Patient Obligations & Responsibilities

  • Accurate Information: You must provide accurate personal and medical information when booking appointments.
  • Appointment Attendance: You should honor confirmed appointments or cancel with reasonable notice as per clinic policies.
  • Direct Payment: All treatment fees must be paid directly to the dental clinic. BookMyDentist does not process treatment payments.
  • Medical Advice: You acknowledge that BookMyDentist does not provide medical advice. All treatment decisions should be made in consultation with qualified dental professionals.
  • Respectful Conduct: You must treat dentists and clinic staff with respect and professionalism.

6. Booking & Appointment Terms

6.1 Booking Process

  • Patients can book appointments through the Platform free of charge
  • Bookings are subject to dentist availability and confirmation
  • Appointment slots are held temporarily during the booking process
  • Confirmed appointments create a direct relationship between patient and dentist

6.2 Cancellations & Rescheduling

  • Patients may cancel or reschedule appointments through the Platform
  • Individual clinics may have specific cancellation policies
  • Dentists should provide reasonable notice when canceling appointments
  • Repeated no-shows may result in booking restrictions

6.3 No-Guarantee Clause

BookMyDentist does not guarantee appointment availability, treatment outcomes, or service quality. We facilitate connections but do not control or supervise the dental services provided.

7. Payment Terms

7.1 Dentist Subscription Fees

  • Dentists pay subscription fees to access Platform services
  • Fees are billed according to the selected subscription plan (monthly or annual)
  • All fees are exclusive of applicable taxes unless stated otherwise
  • Subscription fees are non-refundable except as outlined in our Refund & Cancellation Policy
  • Failed payments may result in service suspension

7.2 Patient Treatment Fees

BookMyDentist does not collect treatment fees from patients. All dental service payments are made directly to the dental clinic. Payment disputes regarding treatment costs must be resolved directly between patients and the clinic.

7.3 Payment Processing

  • Payments are processed through secure third-party payment gateways
  • You must provide accurate payment information
  • Payment processing fees may apply and are non-refundable
  • We do not store complete credit card information on our servers

8. Intellectual Property Rights

8.1 Platform Ownership

BookMyDentist and all related content, features, functionality, logos, trademarks, and software are owned by VCPility and protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

8.2 User Content

By submitting content to the Platform (profiles, reviews, images, etc.), you grant BookMyDentist a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for the purpose of operating and promoting the Platform.

You represent that you own or have the necessary rights to all content you submit and that such content does not violate any third-party rights or applicable laws.

9. Privacy & Data Protection

Your use of BookMyDentist is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices as described in the Privacy Policy.

  • We collect and process personal data in accordance with applicable data protection laws
  • Patient medical information shared with dentists is subject to healthcare privacy regulations
  • We implement reasonable security measures to protect user data
  • You have rights to access, correct, and delete your personal information

10. Prohibited Conduct

Users are strictly prohibited from:

  • Providing false, misleading, or fraudulent information
  • Impersonating another person or entity
  • Engaging in harassment, abuse, or discriminatory behavior
  • Attempting to access unauthorized areas of the Platform
  • Distributing viruses, malware, or harmful code
  • Scraping, data mining, or automated data collection without permission
  • Using the Platform for illegal purposes or to violate any laws
  • Circumventing Platform fees or payment obligations
  • Posting inappropriate, offensive, or unlawful content
  • Interfering with other users' access to the Platform

Violation of these prohibitions may result in immediate account suspension or termination.

11. Disclaimers & Limitations of Liability

11.1 Service "As Is"

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. BOOKMYDENTIST DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11.2 No Medical Advice

BookMyDentist does not provide medical or dental advice. Information on the Platform is for general informational purposes only and should not be considered professional medical advice. Always consult with qualified healthcare professionals regarding medical conditions and treatment options.

11.3 Third-Party Services

BookMyDentist is not responsible for the quality, safety, legality, or any other aspect of dental services provided by dentists listed on the Platform. Dentists are independent professionals, and we do not employ, supervise, or control their services.

11.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKMYDENTIST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM OR SERVICES OBTAINED THROUGH THE PLATFORM.

11.5 Maximum Liability

Our total liability to you for any claims arising from your use of the Platform shall not exceed the amount of fees you paid to BookMyDentist in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless BookMyDentist, VCPility, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Dental services provided by dentists (for dentist users)
  • Any content you submit to the Platform

13. Account Termination & Suspension

13.1 Termination by User

You may terminate your account at any time by contacting us at info@bookmydentist.org. Dentists who terminate their accounts remain subject to subscription terms as outlined in the Refund & Cancellation Policy.

13.2 Termination by BookMyDentist

We reserve the right to suspend or terminate your account immediately, without prior notice, for:

  • Violation of these Terms or applicable laws
  • Fraudulent activity or misrepresentation
  • Non-payment of subscription fees (for dentists)
  • Abusive or inappropriate behavior
  • Any conduct that harms BookMyDentist or other users

Termination for policy violations does not entitle you to any refund of subscription fees.

13.3 Effect of Termination

Upon termination, your right to use the Platform immediately ceases. We may delete your account data, though some information may be retained as required by law or for legitimate business purposes.

14. Dispute Resolution

14.1 Informal Resolution

Before initiating formal dispute resolution, you agree to contact us at info@bookmydentist.org to attempt to resolve the dispute informally. We will make reasonable efforts to resolve disputes within 30 days.

14.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

14.3 Jurisdiction

Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in Kerala, India.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and BookMyDentist regarding your use of the Platform.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

15.5 Force Majeure

BookMyDentist shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, or government actions.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Significant changes will be communicated to users via email or prominent notice on the Platform.

Your continued use of the Platform after changes to these Terms constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of the Platform.
